Nova Strike Terms of Service

These Terms of Service (the "Terms") are a legal agreement between you and Flowzy for the use of the Nova Strike mobile game, including its online features, virtual items and related services (together, the "Game"). By installing or playing the Game you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.

1. Who can play

You must be at least 13 years old to play Nova Strike. If you are under the age of majority where you live, you may only play with the permission of a parent or guardian who agrees to these Terms on your behalf and who is responsible for any purchases made through their store account. The Game is not directed at children under 13.

2. Your account

  • The Game creates an anonymous account on your device the first time you play. You may link an e-mail address so that you can restore your progress on another device. You are responsible for keeping access to that e-mail address and to your device.
  • You may hold one account per person. Do not share, sell, trade or transfer your account or use another person's account.
  • Sign-in codes and links are personal. We will never ask you for them by e-mail or chat.
  • You can delete your account at any time from the Game's Settings. Deleting your account permanently erases your progress and virtual items (see Section 4).

3. Licence to play

Subject to these Terms, Flowzy grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and play the Game on a device you own or control, for your own non-commercial entertainment. All other rights are reserved. The Game is licensed, not sold, to you.

You may not: copy, modify, distribute, sell or rent any part of the Game; decompile, reverse-engineer or extract its source code or assets except where the law expressly allows; remove any proprietary notice; or use the Game in any way that breaks the law or these Terms.

4. Virtual items and virtual currency

  • The Game contains virtual currencies (coins and gems), virtual items (ships, upgrades, chests, upgrade tokens) and subscription benefits (the Nova Pass). Together these are "Virtual Items".
  • Virtual Items are licensed to you for use inside the Game only. They have no real-world value, are not your property, cannot be exchanged for money or anything of value outside the Game, and cannot be transferred to another person or account.
  • We may change, rebalance, replace or remove Virtual Items, adjust their prices and effects, or discontinue them altogether as part of operating and developing the Game. Where we remove a Virtual Item you paid for within a short time before its removal we will try to offer a reasonable replacement.
  • Purchases of Virtual Items are final and non-refundable except where a refund is required by applicable law or by the refund policy of the store you bought them through. Refund requests must be made to the App Store or Google Play, which processed the payment.
  • Chests display the odds of each possible reward before you open them. Chests bought with gems are Virtual Items subject to this Section.
  • Virtual Items you obtain by cheating, exploiting a bug or violating these Terms may be removed without compensation.

5. Purchases and subscriptions

  • All purchases are made through the Apple App Store or Google Play and are subject to their terms, payment methods and refund policies. Prices are shown in the store before you confirm a purchase and may vary by country and change over time. Applicable taxes may be added.
  • Nova Pass is an auto-renewing subscription. It renews automatically at the end of each billing period (monthly or yearly, as chosen) at the price shown in the store, unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours before the end of the current period.
  • You manage and cancel the subscription in your App Store or Google Play account settings (the Game's Settings has a "Manage subscription" shortcut). Cancelling stops future renewals; you keep the benefits until the end of the period already paid for. Deleting the Game or your account does not cancel the subscription.
  • If a free trial is offered, you will be charged when the trial ends unless you cancel before then. Any unused portion of a free trial is forfeited when you purchase a subscription.
  • "Restore purchases" in Settings re-activates a subscription or non-consumable purchase on a device signed in to the same store account. Consumable items (gem packs, the Starter Pack) are granted once and cannot be restored.
  • Virtual Items and subscription benefits are delivered to the account that made the purchase. Keep your account restorable (link an e-mail) if you want to keep them across devices.

6. Advertising

The Game is supported by advertising. Rewarded ads are always optional and clearly labelled; the reward is stated before you choose to watch. The Game remains fully playable without watching ads. Ads are delivered by Google AdMob under the consent choices described in our Privacy Policy. You may not use tools that block, skip or falsify ad views to obtain rewards.

7. Fair play and prohibited conduct

You agree not to:

  • use cheats, hacks, bots, scripts, modified clients, memory editors or any tool that automates play or alters the Game's behaviour, data or scores;
  • exploit bugs or unintended mechanics to gain an advantage (please report them to us instead);
  • submit falsified scores or otherwise manipulate the leaderboards;
  • interfere with the Game's servers or networks, probe or bypass security measures, or send abnormal traffic;
  • use a pilot name that is offensive, hateful, sexually explicit, impersonates another person or organisation, contains personal information, or infringes anyone's rights;
  • resell, farm or commercially exploit accounts, Virtual Items or access to the Game;
  • use the Game for any unlawful purpose.

We use plausibility checks and rate limits to protect the leaderboards and may remove any score, reset any board or rename any pilot at our discretion.

8. Leaderboards and pilot names

Your pilot name, ship and best endless-mode results are visible to other players on the weekly and all-time leaderboards. Weekly boards reset every Monday at 00:00 UTC. Rankings are provided for fun and carry no prize or entitlement unless we announce one in writing. We may edit or remove names and entries that violate Section 7.

9. Ownership

The Game, including its software, artwork, ships, characters, names, music, sound effects, text and design, is owned by Flowzy or its licensors and is protected by copyright, trademark and other laws. Nothing in these Terms transfers any intellectual-property right to you.

10. Availability and changes to the Game

The Game and its online features (cloud saves, leaderboards, account linking) are provided as a live service that we may update, modify, suspend or discontinue at any time. We will try to give reasonable notice (normally at least 30 days through the Game or the store listing) before permanently shutting down online features that affect purchased Virtual Items, except where an immediate change is needed for security, legal or technical reasons. Online features require an internet connection and may be unavailable during maintenance or outages; you may continue to play offline where the Game allows it.

11. Suspension and termination

  • By you: stop using the Game and, if you wish, delete your account from Settings.
  • By us: we may suspend or terminate your access to the Game or to online features, remove Virtual Items, reset scores or rename your pilot if we reasonably believe you have breached these Terms, cheated, abused other players, engaged in fraud (including payment chargebacks on legitimate purchases) or created a legal risk for us. Where the breach is minor we will normally warn you first.
  • On termination your licence ends and you lose access to your account and Virtual Items. No refund is owed for Virtual Items or unused subscription time on termination for breach, except where the law requires otherwise. Sections 4, 9, 12, 13, 14 and 15 survive termination.

12. Disclaimers

The Game is provided "as is" and "as available". To the fullest extent permitted by law, Flowzy disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. We do not guarantee that progress will never be lost; keep your account restorable by linking an e-mail address.

Nothing in these Terms limits or excludes any warranty, guarantee or right that you have as a consumer under the laws of your country and that cannot be excluded by agreement.

13. Limitation of liability

To the fullest extent permitted by law, Flowzy, its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or related to the Game or these Terms, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability to you for all claims relating to the Game will not exceed the greater of (a) the amount you paid us through the Game in the twelve months before the claim arose, and (b) EUR 50.

These limitations do not apply to liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or to any other liability that cannot be limited under the laws that apply to you.

14. Indemnity

If you are not a consumer, you agree to defend, indemnify and hold harmless Flowzy from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Game.

15. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates, excluding its conflict-of-law rules. Disputes will be brought before the courts of the United Arab Emirates, unless mandatory consumer-protection law gives you the right to bring proceedings in the courts of your country of residence, in which case that right is preserved.

If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Before starting any formal proceedings, please contact us at support@flowzy.ai; most issues can be resolved quickly and informally.

16. Apple App Store additional terms

If you obtained the Game from the Apple App Store, the following also applies. These Terms are between you and Flowzy only, not Apple, and Apple is not responsible for the Game or its content. Your licence is limited to use on Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service. Apple has no obligation to provide maintenance or support for the Game. If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the Game (if any) to you; to the maximum extent permitted by law Apple has no other warranty obligation. Flowzy, not Apple, is responsible for addressing any claim relating to the Game, including product-liability claims, claims that the Game fails to conform to legal or regulatory requirements, and consumer-protection claims, and for investigating and resolving any claim that the Game infringes a third party's intellectual-property rights. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Google Play additional terms

If you obtained the Game from Google Play, your use is also subject to the Google Play Terms of Service. Subscription billing, cancellation and refunds for Google Play purchases are handled by Google in accordance with its policies.

18. Changes to these Terms

We may update these Terms from time to time, for example to reflect new features, legal requirements or changes to the Game. The effective date at the top will change, and for material changes we will show a notice in the Game or e-mail you if you have linked an address. Continuing to play after the effective date means you accept the updated Terms. If you do not agree, stop using the Game and delete your account.

19. General

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor of the Game. These Terms, together with the Privacy Policy and any additional rules we publish in the Game, are the entire agreement between you and Flowzy regarding the Game.
